DEAR BENNY: A mortgage broker advised us several years ago to split our mortgage into a $400,000 mortgage and a $100,000 line of credit (we had $300,000 total available on the HELOC). A few months ago, we refinanced our $400,000 mortgage with our current lender. (Our house is assessed at $900,000.) We asked our lender if we could refinance our mortgage up to $500,000, pay down the $100,000 drawn on the HELOC, but still keep the HELOC with the HELOC lender open, and our lender said "yes."

We have now learned from our HELOC lender that our HELOC has been closed. Apparently, our lender was supposed to do paperwork with our HELOC lender to keep the HELOC open, but that was never done. Our former HELOC lender said it can't reopen the HELOC because the "lien has been released," and that we just have to reapply for a new HELOC.

Our HELOC interest rate was in the 2 percent range, and now the quotes to get another HELOC with the same lender are closer to 4 percent. We were counting on the HELOC for a home improvement project, and now we have to apply for a new one. Our home improvement plans are in jeopardy now because these higher HELOC interest rates are going to make it cost so much more than we had budgeted.

What recourse do we have against our mortgage lender, who gypped us out of our line of credit with the HELOC lender? --Star

DEAR STAR: Are you sure that your old HELOC was a fixed rate? Most home equity lines of credit (HELOCs) carry adjustable rates. Thus, your old one may have gone up over time.

More importantly, interest rates are at an all-time low, so you should shop around for the best rate you can find. It is my understanding the most banks are anxious to make such loans and will not charge for setting it up, or at least the charge will be nominal.

If you can get a new HELOC similar to the old one, I wouldn't spend time fighting. However, you can always file a complaint with the Office of the Comptroller if your lender was a national bank.

I strongly urge all homeowners to obtain a HELOC if they have any equity in their home. You don't pay interest until you borrow on that line, and it's nice to have a checkbook sitting in your desk drawer for that rainy day.

DEAR BENNY: You say that renting out a basement calling it a "mother-in-law" suite is illegal. Is that true in all states?

I have a finished basement with a separate kitchen, den, bath and bedroom. Other parts of the basement are shared: laundry room, recreation room, exercise area, second bathroom and my office. Please note I also have a laundry area upstairs.

A very good friend of mine lost his house due to reduced income after a local college dismissed 58 faculty/staff members, and he and his teenage son needed a place to live. I have let them stay with me for the last several months rent-free while the friend seeks a full-time teaching position and works at minimum wage.

I have considered putting up a mailbox and allowing them to get their mail there. Will that hurt me? I am sure that once a mailbox goes up, the county will consider it more developed and taxes may go up. Are there any other implications I should be concerned about?

I have seen the movie "Pacific Heights" and often tell people about that movie when discussing horrible renters. I'm not concerned about a roommate going bad. If I don't charge them rent, can he use the other address without it causing either one of us problems? First direct detection sheds light on dark galaxies

ScienceDaily (Oct. 30, 2012) ? Most people think of galaxies as huge islands of stars, gas and dust that populate the universe in visual splendor. Theory, however, has predicted there are other types of galaxies that are devoid of stars and made predominately of dense gas. These "dark" galaxies would be unseen against the black backdrop of the universe.

Now, an international team of astronomers has detected several dark galaxies by observing the fluorescent glow of their hydrogen gas, illuminated by the ultraviolet light of a nearby quasar. But what exactly are dark galaxies, and what role do they play in the evolution of our universe?

"Dark galaxies are composed of dark matter and gas, but for some reason they have not been able to form stars," said Martin Haehnelt, Kavli Institute for Cosmology at the University of Cambridge. "Some theoretical models have predicted that dark galaxies were common in the early universe when galaxies had more difficulty forming stars -- partly because their density of gas was not sufficient to form stars -- and only later did galaxies begin to ignite stars, becoming like the galaxies we see today."

Haehnelt is a member of the scientific team that detected these galaxies. According to Haehnelt, one can begin to understand the importance of dark galaxies by looking at our own Milky Way. "We expect the precursor to the Milky Way was a smaller bright galaxy that merged with dark galaxies nearby. They all came together to form our Milky Way that we see today."

Another member of the team, Sebastiano Cantalupo of the University of California, Santa Cruz, agreed that dark galaxies are the building blocks of modern galaxies. "In our current theory of galaxy formation, we believe that big galaxies form from the merger of smaller galaxies. Dark galaxies bring to big galaxies a lot of gas, which then accelerates star formation in the bigger galaxies."

The techniques used for detecting dark galaxies also may provide a new way to learn about other phenomena in the universe, including what some call the "cosmic web" -- unseen filaments of gas and dark matter believed to permeate the universe, feeding and building galaxies and galaxy clusters where the filaments intersect.

"I wonder if we can indeed use this technique to see the emission of filamentary gas in the cosmic web, and if so, how close are we to seeing that?" said team member Simon Lilly of the Swiss Federal Institute of Technology in Zurich, Switzerland. "That has been something of a Holy Grail for many, many years and I think this most recent discovery of dark galaxies is a significant step toward the goal."

Vegan Recipes | Baked Cinnamon Donuts ? Like A Vegan

Oh. My. God. Why have I not made donuts before?! To be honest, it just didn?t strike me as worth it until I started to crave them recently but I?ll be the first to admit I?m an absolute IDIOT for not trying them until now. While they do take some time to make, the results speak for themselves and you?ll have your friends and family begging you for more! Stay tuned for many more donut recipes, I?ve got a feeling I?ll be making them much more often.

Ingredients

  • 1 cup soy milk
  • 1 teaspoon apple cider vinegar
  • 7 gram packet dry yeast
  • 1/4 cup Nuttelex, melted
  • 1 teaspoon vanilla
  • 3/4 cup caster sugar
  • 2 1/2 cups plain flour
  • Spray oil
  • 2 teaspoons ground cinnamon

Method

  1. Warm your milk in in the microwave for a minute before whisking through the apple cider vinegar and setting aside for a few minutes.
  2. Pop the mixture into a large bowl before adding the yeast and ?1 tablespoon of melted butter. Allow to sit for a few moments before adding the vanilla and 1/4 cup of caster sugar.
  3. Sift in the flour and combine well in the bowl before tipping out onto a lightly floured surface.
  4. Knead with your palms for about 10 minutes until the dough is smooth.
  5. Spray a large bowl with spray oil and roll the dough around to coat it. Cover and allow to rise for one hour.
  6. Preheat the oven to 200?C and line two baking trays with baking paper.
  7. Punch down the dough and tip out onto a lightly floured surface. Give it another light knead for a couple of minutes before rolling the dough out to be about 2cm thick.
  8. Now you need to cut out your donut shapes! If you?re going for your traditional donut shape, you can cut out using a large drinking glass and making the hole with a small lid (from an olive oil bottle for example). This will give you a regular sized donut. You may need to re-roll the dough to get the full dozen donuts but hang onto the holes and any excess dough.
  9. Space your donuts out six to a tray, you can scatter the holes on the trays too. Cover each tray with a tea towel and allow the donuts to rise for another half an hour.
  10. Pop the trays in the oven and cook for about 10-15 minutes, until they?re lightly golden.
  11. Allow to cool for about 10 minutes. In the meantime you can combine the remaining sugar and cinnamon in a shallow bowl.
  12. With a pastry brush, cover each donut with melted Nuttelex before dunking in the cinnamon mixture. Make sure it?s evenly coated and gently shake of the excess.
  13. Best served warm but will keep for a couple of days.

Skywalk case goes before federal appellate court

(AP) ? A Las Vegas developer has been bounced between tribal and federal court in an effort to protect his financial interest in the Grand Canyon Skywalk, a popular glass bridge that extends from the canyon's edge on tribal land in western Arizona.

On Friday, David Jin's attorneys will argue before the 9th Circuit U.S. Court of Appeals that the Hualapai tribal court system hasn't given Jin a fair shot and that he shouldn't have to fight his legal battles there.

The tribe has denied those allegations and will urge the San Francisco court to uphold a ruling that said Jin first must exhaust remedies in tribal court. By signing a contract with a business arm of the tribe in 2003, Jin allowed it to be governed by Hualapai law, the tribe said.

Jin invested $30 million to build the horseshoe-shaped bridge that gives visitors a view of the Colorado River 4,000 feet below. He and the Hualapai Tribe have been locked in a contract dispute that led the tribe to sever the contract with Jin and for Jin to pursue legal action for alleged constitutional violations.

The contract dispute itself isn't up for review by the appellate court, only the jurisdictional question. There is an exception to exhausting tribal court remedies if Jin's attorneys can prove that the tribal court ? not the Tribal Council ? has acted in bad faith. He's been unsuccessful so far.

Jin also argues that the tribal court lacks civil jurisdiction over him and the corporation he formed to manage the Skywalk, the Nevada-based Grand Canyon Skywalk Development.

No court has ruled on Jin's claims that he is owed for years of unpaid management fees or the tribe's claims that Jin failed to complete a visitor center. A tribal court judge rejected an attempt by Jin to force arbitration because the tribal defendants are protected from lawsuits by sovereign immunity. The federal District Court repeatedly has said that the tribal court has the first right to hear the case. The two sides don't agree on an arbiter's decision to award Jin about $28 million in the contract dispute.

Indeed, Wright noted that when DC increased survivor benefits from $5,000 to $25,000 a year, Peavy said she understood and agreed to the admonition from then-Executive Vice President Paul Levitz that, ?this agreement would represent the author/heir?s last and final deal with DC, and would fully resolve any past, present, or future claims against DC.? The judge also pointed out that under a 1975 agreement with Siegel and Shuster, DC provided each of the two creators with lump sums (in today?s dollars) of $75,000 and lifetime annual payments of $80,000, survivor benefits and insurance ? ?as well as ?credits? on new Superman works? ? amounting to more than $4 million (not counting medical benefits and ?bonuses?).

In a statement to The Hollywood Reporter, Toberoff, who also represents the Siegel family, said, ?We respectfully disagree with its factual and legal conclusions, and it is surprising given that the judge appeared to emphatically agree with our position at the summary judgment hearing.?

The trade paper suggests, however, that Toberoff may find cause for appeal in Wright?s comment that, ?The broad and all-encompassing language of the 1992 agreement unmistakably operates to supersede all prior grants.?

Still ahead is a Nov. 5 hearing before the 9th Circuit Court of Appeals in which DC will argue the 2008 ruling that found the Siegel family had reclaimed its stake in Superman should be overturned. Toberoff will also seek to define precisely what elements of the characters are covered by the decision.

Supreme Court gives Obama camp a win in Ohio early voting tussle

(Reuters) - The U.S. Supreme Court on Tuesday denied Ohio's request to curtail early voting in the state, a victory for President Barack Obama's re-election campaign which had battled Republican efforts to scale back in-person balloting in the days leading up to Election Day.

Ohio, critical to the election hopes of Obama and his Republican challenger Mitt Romney, began early in-person voting earlier this month but planned to cut it off on November 2, the Friday before the election, except for members of the military.

The Obama campaign, the Democratic National Committee and the Ohio Democratic Party had sued Ohio officials to restore early voting right up to the eve of election day. Republicans opposed their efforts, saying a cutoff was needed to reduce voter fraud and ease the burden on election officials.

In states that allow voters to cast ballots before election day, early voting and extended voting hours are thought to benefit Democratic candidates because lower-income people, who tend to vote for them, are more likely to work odd hours.

According to a Reuters/Ipsos national survey, about 10 percent of likely voters have already cast ballots. And of those who have voted, Obama holds a sizable lead over Romney - 56 percent to 35 percent. The poll has a credibility interval, a measure of accuracy, of plus or minus about five percentage points.

That contrasts with a much closer race according to polls of likely voters. There, the president holds just a slight edge of 46 percent to 43 percent in Tuesday's Reuters/Ipsos daily tracking poll.

Earlier this month, the 6th U.S. Circuit Court of Appeals upheld a U.S. District Court order that reinstated early voting in the final days before the election. The state had appealed that ruling to the Supreme Court.

'END OF THE ROAD'

In a one-sentence order on Tuesday, the high court denied the state's petition for a stay of the appeals court decision.

"This action from the highest court in the land marks the end of the road in our fight to ensure open voting this year for all Ohioans, including military, veterans, and overseas voters." Obama campaign General Counsel Bob Bauer said in a statement.

Ohio Secretary of State Jon Husted, the state's top elections official, called the 6th Circuit's decision an unprecedented intrusion by federal judges into state elections that was illegal and impractical.

"Despite the court's decision today to deny our request for a stay, I firmly believe Ohio and its elected legislature should set the rules with respect to elections in Ohio, and not the federal court system," Husted said in a statement. "However, the time has come to set aside the issue for this election."

The appeals court's decision did not require polls to be open on the final three days, leaving it up to the discretion of the state's 88 individual county election boards.

Following the Supreme Court ruling, however, Husted directed all state polling places to adopt the same hours for the balance of early voting.

"Today I have set uniform hours statewide, giving all Ohio voters the same opportunities to vote in the upcoming presidential election regardless of what county they live in," Husted said.

For the final three days before the election, Ohio voters may cast ballots between 8 a.m. and 2 p.m. on Saturday, November 3; from 1 p.m. to 5 p.m. on Sunday, November 4; and from 8 a.m. to 2 p.m on Monday, November 5.

A coalition of 15 states, including Colorado, Wisconsin and Virginia, filed a supporting brief for Ohio on Friday, encouraging the court to block the 6th Circuit's ruling. They said Ohio had not placed a burden on citizens' ability to vote by eliminating the three early voting days.

Huntersville painter shares talent through teaching | Huntersville ...

When Huntersville-based painter Mary Crow was a third-grader living West Virginia, a teacher allowed her to complete drawings during free classroom time.

It was in this part of her life that Crow realized she had a passion for creating art, allowing her artistic talents to blossom. Crow, now a substitute teacher, recently received a lateral entry teaching license and hopes to help other young artists find their artistic visions.

?I was always entering those art contests at school and found a lot of encouragement from my teachers,? she said.

Crow will be one the artists featured in the Denver Art Trail, which takes place Oct. 20-21. Crow uses oils and pastels to paint portraits of people and pets, as well as landscapes. She said she enjoys experimenting with different lighting effects in her arts.

?I?m always challenged by the variety of subject matter in portraiture and landscapes,? she said. ?It?s always exciting to work on a new portrait or to find a new beautiful landscape that I might enjoy working on.?

Developing her artistic talent through childhood and high school, Crow attended the Columbus College of Art and Design for a year before transferring to West Virginia University where she majored in painting and printmaking. She moved to North Carolina in 1994.

Residents around the region might find some her pieces familiar. Pieces Crow plans to display during art trail include paintings of Bradford Farm in Huntersville and Grandfather Mountain in the Blue Ridge Mountains.

She is an active member of the Charlotte Plein Air Painters, a group of area artists who meet in and around Charlotte who participate in monthly ?paint outs.?

Crow also contributes pet paintings for local animal shelters and networks to use in auction or raffle fundraisers. A portrait she painted of St. Mark Catholic Church pastor Rev. Msgr. Richard Bellow hangs in the Huntersville church?s Narthex to honor his efforts to build a new church sanctuary.

?I feel that my artistic bent is a gift from God and I try to use that as a service for him whenever I feel inspired,? Crow said. ?I also enjoy contributing paintings to service groups that help the homeless.?

In addition to teaching children as a substitute teacher in the area?s public schools, she offers private painting lessons to teenagers and adults. She invites people interested in commissioning a portrait to visit her on the Denver Art Trail as well.

?I can talk to them about the process and the types of photos they need,? Crow said. ?Sometimes people don?t realize that there are portrait artists in the area that can be commissioned for work.?

Jealousy: Could An Open Relationship Cure It? - Huffington Post

We?ve always said that if you want to be in an open relationship, it helps if you?re the kind of advanced human being who is missing the jealousy gene. (Neither of us comes even remotely close, for the record.) It just seems like, if you?re going to be cool with your one-and-only kissing someone else or going down on someone else, then the Green-Eyed Monster is an unwelcome guest at the sex party.

So we were surprised to read a personal essay in the New York Times last weekend by a woman who claims that her open-ish relationship helps her husband handle his fears that she will cheat on him or leave him.

It may seem eccentric that my husband has translated the common fear of being cheated on into enthusiasm for the idea, but he?s not alone. Type ?cuckold? into a pornography search engine and you?ll be greeted with countless scenes in which people play out that exact fantasy.

The writer, Ada Calhoun, explains how, of the two of them, she was the sexual adventurer before they met, the one who?d had more sexual encounters, more fleeting encounters, more casual sex.

Because of this, my husband has at times fretted that I might leave him. What should he do with that anxiety? Maybe eroticizing it isn?t the worst strategy, especially if it gets us talking about what turns us on and keeps us in the loop about each other?s lives. Surely it?s better than the more mainstream reactions to jealousy: becoming paranoid or controlling.

In theory, it sounds kind of awesome. It?s not entirely clear ? even to the author herself ? how far she is permitted to go. The only real rule they have, it seems, is that she always be completely honest. In other words, her husband never has to worry about what she?s really thinking or what she really desires to do, because he?s given her permission to explore her desires and she has promised to tell him everything. It?s the rubber band vs. ball-and-chain theory of marriage.

And yet. We still can?t imagine how this works in practice, when the husband in question is already jealous and insecure. Sure, this approach could cure his jealousy, kind of like shock treatment ? but could it also lead to years of pent-up jealousy and resentment?

Also, it?s not entirely clear whether he?s allowed to kiss and tell too. Which seems odd until you get to this, more than halfway through the article:

Years ago, my husband told me he had fallen in love with someone else. He was deeply confused and scared by it. I didn?t even know who he was talking about; that?s how much of a secret he had kept his growing feelings. When he told me who it was, a co-worker, I felt as if I had been shot. I broke things. I threw him out. He ended the affair. Since then, I?ve forgiven him, and we?ve worked hard to figure out why it happened and what it meant.

Um, WHAT??!! Talk about burying the lede! Is this why she gets to kiss other people, because he once cheated? Is he afraid she?ll leave because he is a cheater? Did he feel like he owed her something after this? Suddenly the open-ish relationship seems a whole lot messier and unresolved. An affair seems like a pretty shaky foundation to build this kind of modern, break-the-rules relationship on (unless the affair came after the agreement to be open and monogamish, which is even worse). And yet, we can kind of get the explanation:

The main thing that helped me get over the affair was realizing that attraction to other people isn?t necessarily a sign your marriage is bankrupt. In the course of being together forever, especially if you?re out in the world meeting new people, it happens. One of the challenges in a marriage, in addition to deciding whose job it is to do the dishes and how to balance the budget, is to figure out how to deal with lust or love for other people.

YES. Yes, yes, yes, yes, yes, yes, yes. We couldn?t agree more! We wish more people understood that attraction to people besides your spouse is normal and usually fleeting and nothing to fret about at all. If you can understand that ? whether or not you want to pursue those attractions ? your marriage will be so much more robust.

In the meantime, though, it sounds like this particular open relationship could use a few more rules and guidelines. That?s the problem with open relationships: When you bust out of society?s expectations of monogamy ? and believe us, we applaud the couples who do ? and forge new ground, you can?t rely on tradition or precedent to tell you how to behave. You need to work to get on the same pages as a couple, and we don?t care if doing so involves a dorky list of rules*. Or maybe a Google doc that you can edit and share ? there?s a nice metaphor for your relationship! Your marriage, however you define it, is worth it.

* Then again, we suppose that publishing an article about your vague open relationship in a national newspaper that will be read by your parents and your in-laws and your co-workers and your childhood friends and pretty much everyone you know is another good way to figure things out!

Happy Birthday, Lance Olsen! ? BIG OTHER

Today, October 14, 2012, marks Lance Olsen?s 56th birthday. In celebration of him and his work, and with a nod to a quote by Roland Barthes, I?ve turned most of the sentences found in the first chapter of Olsen?s The Architectures of Possibility into questions without answers. (You?ll also find that I?ve altered quotations, found in the selfsame chapter, from Brian Evenson, Fredric Jameson, and Curtis White, as well as the abovementioned Barthes).

The TV Land Electorate

It?s the middle of October, which means that our favorite characters from the small screen will soon be choosing their candidates, heading to the polls, and casting their votes.

Or maybe not: Many of the most popular TV characters tend to keep quiet about their politics, avoiding naming names and party affiliations, lest they alienate any of their viewers. Although Friday Night Lights author Buzz Bissinger recently endorsed Mitt Romney?the Romney campaign has even taken to using the show?s famous ?clear eyes, full hearts? slogan?the Friday Night Lights series itself is firmly nonpartisan: While we may argue about which side of the aisle the characters belong on, it?s all speculation. Series creator Peter Berg even rejected the Romney move, telling the candidate in a letter, ?Your politics and campaign are clearly not aligned with the themes we portrayed in our series.?

There are some exceptions, though, and they range across both the political spectrum and the TV dial. We?ve assembled some of our favorite faces from the small screen who have expressed actual political affiliations?and the results are fantastically bipartisan. The selection below is not meant to be comprehensive, but rather to reflect the sheer diversity of political affiliations on television. To the far right are Springfield Republican Party chairman Mr. Burns and Parks and Recreation?s Ron Swanson (who has characterized the government as ?a greedy piglet that suckles on a taxpayer?s teat until they have sore, chapped nipples?), while to the far left we have the flower-child Keatons of Family Ties and former Dennis Kucinich supporter Brian Griffin. Most fall somewhere near the middle: Homer Simpson is voting for Mitt Romney in 2012, but only because he ?invented Obamacare.?

To understand our reasoning behind each character?s placement, simply mouse over the faces above. And if you have a favorite partisan protagonist who isn?t represented, let us know where you think he or she would fit in the comments.

Obama witch doctor display to stay, creator vows

The calendar is flipping toward two big late-fall events: Halloween and the presidential election.

A business owner has married the two in his New Jersey storefront. His anti-Obama, Halloween-themed window displays the president as a witch doctor.

Expression of free speech? Maybe. But also a bad business decision, apparently.

The voodoo storefront has evoked outrage in the beachfront community of Spring Lake, N.J. But Bill Skuby, 66, owner of the local men's store, Skuby & Co. Lifestyle Clothing, insists that the display is not political. ... "It's personal."

The store's window display depicts an image of Obama's head superimposed in the body of a witch doctor that rests atop the word "Obamacare." The witch doctor image is placed under a tombstone epithet that reads, "I Told You I Was Sick," accompanied by a photo of the president in a doctor's coat and stethoscope.

On the tombstone stands an Obama bobble-head doll sporting a long-sleeved tee that reads, "Hoax," and underneath that is a zombie mannequin rising from the dead wearing a hat that says "F.Y.B.O.," an acronym apparently for an expletive phrase denouncing the president.

"This whole thing started as a statement from an individual voicing his opinion," Skuby told ABC News during a phone conversation that was briefly interrupted when someone from the street came in to give him a piece of their mind. "Now it has brought total negativity to Spring Lake."

The display has generated both outrage and support, ABC News' New York City station WABC reported.

"Our children and grandchildren can walk by, and I think this represents the worst that America can display in campaigning," said Spring Lake resident Suzanne Herrmann.

But Ray Miller told WABC's Jen Maxfield, "Good for [Skuby]. Someone has to stand up for our country."

The Halloween-themed display debuted Oct. 4. Skuby said that he did a similar one last year "and no one said a word. But this is an election year and now, suddenly, everyone wants to be involved."

The store owner said he has received a wave of threats from all over the country aimed at him and his six children, including death threats that he has reported to the police.

"This is America, isn't it?" Skuby asked. "Aren't we able to say and do pretty much what we want to do?"

Skuby, who admitted that his business has suffered because of his visual expression, said the community is trying to run him out of town. He said people have made him out to be a racist because of his anti-Obama display.

"If you want to call me a racist then go ahead. I can assure you I am not a racist; I just really want to see Obama go." Skuby said. "This is a good example of where race relations are under this guy's administration. ... This has absolutely nothing to do with race."

Skuby said that if Mitt Romney had the same plan as the president; his picture would be in the window.

Skuby said he isn't taking the display down until after the holiday.

"My window is my voice and I get one shot to have my voice be heard." he said. "I don't regret putting up the display. At some point, you have to take a stand and that is what I am doing. I want Obama out."

DOVER, N.H. (AP) ? A martial arts instructor active in community theater was charged Saturday in the death of a 19-year-old University of New Hampshire student who disappeared days earlier.

Elizabeth "Lizzi" Marriott, a marine biology major who volunteered at the New England Aquarium, is believed to be dead and law enforcement officials continued to search for her body, Assistant Attorney General James Vara said Saturday.

Seth Mazzaglia, 29, of Dover, who's charged with second-degree murder, knew Marriott, Vara said, but he declined to say how or what led to Mazzaglia's arrest. He said police had "credible" information leading them to believe Marriott is dead, though he wouldn't elaborate.

"This is the worst parents nightmare, a missing child and with an unfavorable outcome,' Marriott's family said in a statement Saturday. The family asked for prayers for rescue personnel who are looking for their daughter, saying they need to "bring her home."

A family friend, Dawn Downey of Westborough, Mass., described Marriott as an attractive young woman who was active in chorus in high school and was prom queen during her junior year. Marriott was helping to put herself through college by working at Target.

"She was just a good girl. That's probably what got her in trouble. She was too trusting and she was beautiful. Those two things will kill you," Downey said.

Marriott had attended a class Tuesday night and made plans to visit friends in Dover. Her cellphone was last used in Dover that night, according to fliers that family members posted around town. Her car was later found in a parking lot on campus in Durham.

"We were greatly saddened to learn of Lizzi's death and we extend our deepest sympathies to her family and friends," UNH President Mark W. Huddleston said in a statement. "Lizzi was a new member of the university community and will be missed in our classrooms. Our focus now will be on supporting our campus community during this difficult time."

The university was making counselors available to students. A moment of silence was planned in Marriott's honor at the school's hockey game Saturday night.

Marriott was a 2011 graduate of Westborough High School in Massachusetts. She lived with an aunt in Chester and commuted to the Durham campus. A message seeking comment was left with her parents, Robert and Melissa Marriott of Westborough.

Hundreds gathered for a vigil Saturday night in Westborough.

Robert Marriott told the crowd, "Together we created an angel, and tonight she is home in heaven."

Downey's daughter Nicole, who was Marriott's best friend, described Marriott as a "fun-loving and goofy" young woman who got along easily with others and had a wide circle of friends. She also was a good student who loved animals and science and volunteered at the New England Aquarium in Boston, Nicole Downey said.

"It was a shock to me when I found out she was missing. That was not like her at all," she said. "She was just all around a great person. I don't know why anyone would want to hurt her."

Mazzaglia, who graduated from the University of New Hampshire in 2006 with a bachelor's degree in theater, was active in the arts, performing in several dozen plays and musicals over the last decade in southern New Hampshire.

He also was a martial arts instructor who described himself on websites as having a black belt in karate and being familiar with several forms of martial arts and weapons. And he described other interests including juggling.

Robert Modee, a friend of Mazzaglia's and a martial arts instructor in Kittery, Maine, said he was struggling to comprehend how his friend could be charged with murder.

"I don't understand what's going on right now," he told the Foster's Daily Democrat in Dover, N.H. "I'm completely floored with all this."

Mazzaglia is scheduled to be arraigned Monday. A working telephone number for him could not immediately be located. It was unclear whether he had a lawyer yet.
